The terms "We", "us", or "our" refer to The Urban Stree, a firm incorporated in India, with its registered office located in Guwahati, Assam. The terms "You" or "your" refer to the individual using our website to purchase goods from us.
1 INTRODUCTION
1.1 In this agreement, the terms "We", "us", or "our" refer to The Urban Stree. We provide this website, including all information, tools, and services available on the site.
1.2 By purchasing goods on our website, you agree to be legally bound by the terms of this contract.
1.3 Purchases from our site are for personal use only and not for commercial purposes.
1.4 This contract is solely available in English, and no other languages will be applicable.
2. Ordering Goods from Us
2.1 This section explains how a legally binding agreement is formed between you and us.
2.2 To place an order, you must register on our site with accurate, up-to-date, and complete information. You are responsible for keeping your password secure and must notify us immediately if you become aware of any security breaches or unauthorized use of your account.
2.3 To place an order, add your chosen item(s) to your shopping bag and proceed to checkout. Please note that items in your shopping bag are not reserved and may be purchased by other customers. Be sure to review your order carefully before submitting it.
2.3.1 After completing the checkout process (i.e., clicking "Pay"), we will send you an email acknowledging receipt of your order. However, this does not mean your order has been accepted.
2.3.2 We may contact you to inform you that we cannot accept your order for reasons such as:
(a) The goods are out of stock;
(b) We are unable to authorize your payment;
(c) You are not permitted to purchase the goods from us;
(d) We are restricted from selling the goods to you;
(e) You have ordered an excessive quantity; or
(f) There has been an error in the pricing or description of the goods.
2.3.3 Your order will only be accepted once we send you a Confirmation Email. At that point:
(a) A legally binding contract will be established between you and us; and
(b) We will either dispatch the goods to you or provide you with an estimated dispatch date.
3. Delivery
3.1 Once your order is placed, it cannot be cancelled. The contract is considered complete upon receipt of your order.
3.2 We will deliver your items using the delivery method you select during the checkout process.
3.3 The estimated delivery date for your items will be provided in the Confirmation Email (see clause 2.3.3). Please note that this date is an estimate, and we do not guarantee delivery by that date.
3.4 All deliveries must be signed for by someone at the delivery address. By signing for the goods at the delivery address, you confirm that the goods have been delivered to you, and the signature serves as proof of delivery.
3.5 If no one is available to accept the delivery, please contact us using the provided details to arrange an alternative delivery.
3.6 Unless otherwise agreed upon, if we are unable to deliver your items within 14 days, we will:
3.6.1 Notify you;
3.6.2 Cancel your order; and
3.7 You assume responsibility for the goods once they are delivered. This means that the risk of loss or damage to the goods passes to you upon delivery.
3.8 We may choose to deliver your order in multiple shipments.
4. Payment
4.1 We accept the following payment methods: Visa, MasterCard, Visa Debit, Visa Delta, Electron, and PayPal. No other payment methods are accepted.
4.2 We will take reasonable measures to ensure that all information you provide when making a payment is secure, using an encrypted payment mechanism. However, except in cases of our negligence, we are not legally responsible for any loss you may incur if a third party gains unauthorized access to your information.
4.3 Your credit or debit card will only be charged once the goods have been dispatched.
4.4 The price of the goods is displayed in the currency shown at checkout. You are responsible for any additional fees or charges that your payment card provider may apply for payments made in that currency.
4.5 If a product is listed at an incorrect price or with inaccurate information due to an error, we may either contact you for further instructions or cancel your order and inform you of the cancellation. We reserve the right to adjust the price and contact you for further instructions or cancel the order and notify you of the cancellation.
4.6 The price of the goods does not include the cost of delivery, which will be displayed separately at checkout and in the Confirmation Email.
4.7 For deliveries within India, the price of the goods includes sales tax and duties.
5. Nature of the Goods
5.1 While we make every effort to ensure that the weights, sizes, and measurements listed on our site are accurate, there may be slight variations between the dimensions of the items shown online and the actual goods we deliver. 5.2 We strive to accurately display the colors of our products on the site; however, the actual colors you see may vary depending on your monitor settings. 5.3 Many of our garments are hand-finished or hand-embroidered. Due to their handcrafted nature, these garments may feature slight irregularities and may differ from the examples shown on the website. This is not considered a manufacturing defect. 5.4 The packaging of the goods may differ from what is shown on the site.
6. Made to Measure
6.1 We create made-to-measure garments based on the specifications you provide when placing your order. If you wish to modify your specifications after we have confirmed your order, please contact us at theurbanstreeguwahati@gmail.com as soon as possible. If we are contacted before the garments have been dispatched, we will make reasonable efforts to accommodate the change. Please note that an additional fee may apply for such modifications.
7 RETURNS OR EXCHANGES
7.1 This clause 7 sets out the only circumstances in which we will accept returns or offer refunds for goods. We will not accept returns or offer refunds for goods unless they are faulty. For this purpose, the customer needs to notify us within 3 days from the date of delivery and send it back to our unit within 7 days.
7.2 If your goods are faulty when they are delivered, you may return the faulty goods to us. If you return the goods to us we will (at our option) repair or replace the goods.
7.3 In order to return faulty goods you must contact us at theurbanstreeguwahati@gmail.com to inform us that you wish to return the goods. We only accept returns if you received a damaged product from us. Please refer to our size charts to confirm sizes before placing your order, as products that have been delivered cannot be returned for size changes. We will then provide you with details of where to return the goods and how to complete the returns process. You will be responsible for the costs of delivering the goods back to us.
7.4 If we repair or replace the goods we will deliver the repaired or replaced goods to you at no additional cost to the delivery address you specified when you purchased the goods.
7.5 If we provide a refund we will pay it to the account you used to purchase the goods if at all the product is out of stock but for other reasons that dont fit in our policy, we will offer you refund.
8 END OF THE CONTRACT
If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
9 DISPUTES
9.1 We will try to resolve any disputes with you quickly and efficiently.
9.2 If you are unhappy with the goods, our service to you, or any other matter, please contact us as soon as possible.
10.Intellectual Property
10.1 All content on this website, including images, text, and logos, is the property of The Urban Stree.
11 THIRD PARTY RIGHTS
No one other than a party to this contract has any right to enforce any term of this contract.
12. Our Right to Amend Terms
We reserve the right to modify these terms at any time and encourage you to review them periodically to stay fully informed. Any changes will take effect immediately upon being posted on the website. By continuing to use the website, you agree to the updated terms. We may, with or without prior notice, revoke any rights granted under these terms. You are required to comply promptly with any termination notice, including by ceasing all use of the website, as applicable.
13.Indemnity & Circumstances Beyond Our Control
We will not be held liable or responsible for any failure or delay in fulfilling our obligations under a contract due to events beyond our reasonable control. A Force Majeure Event refers to any occurrence, event, non-occurrence, omission, or accident that is beyond our reasonable control, including, but not limited to, strikes, lockouts, or other industrial actions; civil unrest, riots, invasions, terrorist attacks or threats; war (declared or undeclared) or the threat of war; natural disasters such as fires, explosions, storms, floods, earthquakes, or epidemics; the unavailability of transportation (rail, air, road, or sea); disruption of public or private communication networks; or government acts, decrees, regulations, or restrictions, including pandemics.
In the event of a Force Majeure, our performance under the contract is considered suspended for the duration of the event, and we will be granted an extension of time to fulfill our obligations. We will make reasonable efforts to mitigate the impact of the Force Majeure event and explore solutions to ensure the continuation of our obligations despite such circumstances.
